MIX Coworking ("We", "Us") provides coworking and office facilities in Clonakilty, Cork, Ireland. By using our services, you agree to comply with these Terms of Use.
1. Acceptance of Terms
By accessing or using our services, you agree to be bound by these Terms of Use. MIX Coworking reserves the right to update or modify these Terms at any time. We will make reasonable efforts to notify users of any significant changes.
2. Description of Services
MIX Coworking provides coworking facilities, including:
Desk space, private pods/offices, and meeting rooms
Internet access, office equipment, phone booths, and other workspace amenities
Knowledge resources and shared space for community events
These offerings (collectively, the "Services") are provided in accordance with these Terms.
Please Note: This agreement does not create a landlord–tenant relationship.
3. Lawful Use of Services
You agree to use the Services only for lawful purposes. You must not:
Use the Services in any way that is illegal or prohibited.
Damage, disable, or interfere with the network or other users' enjoyment of the Services.
Attempt to gain unauthorised access to our systems or data.
Use the Services to obtain materials or information not intentionally made available.
You represent that you have the legal authority to enter into this agreement and that your use does not breach any other contract or legal obligation.
4. Responsible Use
When using the Services, you agree not to:
Send spam, chain letters, or unsolicited communications.
Harass, threaten, or defame others.
Share or post offensive, obscene, or illegal material.
Upload or share content you do not have the rights to use.
Infringe on the intellectual property or privacy rights of others.
Engage in cryptocurrency mining.
Upload viruses, malware, or any harmful software.
Restrict others from using the Services.
Collect or share personal data without consent.
5. Security and Property Care
You agree to:
Respect the quiet enjoyment and use of the space by others.
Avoid damaging or defacing property, furniture, or equipment.
Take reasonable steps to maintain the security of the building and occupants.
Refrain from sharing keys, access codes, or entry details with others.
If you cause accidental damage, you will be invoiced for repair costs.
Please note: Private Pod users are responsible for securing their own space with the door key. MIX Coworking may enter private pods when reasonably necessary (e.g. lights or equipment left on, cleaning, or health and safety reasons).
6. Limitation of Liability
To the maximum extent permitted by law, MIX Coworking and its affiliates, officers, and employees are not liable for any of the following if they arise out of using the Services.
Loss of profits, data, or information
Business interruption or loss of privacy
Damage to personal property or equipment
Indirect, incidental, or consequential damages
This applies even if we have been advised of the possibility of such damages.
7. Indemnity and Personal Property
You agree to indemnify and hold MIX Coworking and its affiliates harmless from any claims, losses, or damages arising from your actions, negligence, or misconduct while using our Services.
MIX Coworking's insurance does not cover your personal property and equipment. We provide lockers for your convenience, but you remain responsible for your belongings at all times.
8. Payments and Cancellations
a. Upfront Bookings
Payment is required at the time of booking
Payments are processed securely via Stripe (stripe.com/docs/security).
Prices are displayed on our website and are subject to 23% VAT.
We provide a full cancellation/refund up to 48 hours before your booking. We provide a 50% refund up to 24 hours before your booking. We provide a 25% refund if you notify us within 24 hours that you will not make your booking. Cancellations must be made by email.
b. Desk Plans / Memberships
Direct Debit payments are processed via Stripe, or alternatively by bank transfer.
Invoices must be paid within 14 days of issue.
All prices are subject to 23% VAT unless exempt.
Desk Plans have a 2-month minimum commitment and do not carry a deposit fee.
You may pause your plan during June, July and August.
Discounts are provided if you would like to:
Pay 12 months upfront → 1 month free
Pay 6 months upfront → ½ month free
Changes, pauses, or cancellations require 2 weeks' notice before the next billing cycle.
If your employer pays for your plan, they may reclaim VAT where eligible.
9. Termination
We may suspend or terminate your access to the Services if you breach these Terms or fail to pay fees when due.
10. Insurance
MIX Coworking holds Public Liability Insurance. However, this does not cover your personal belongings or equipment. We recommend you maintain your own insurance to cover your property while on the premises. We provide lockers for your convenience, but you remain responsible for your belongings at all times.
11. Health & Safety
As a User of the "Services", you are expected to read The MIX Health & Safety Policy Document, which is publicly available in the building. This includes Fire and Emergency evacuation, Workstation and Display Screen Equipment best practices, and general housekeeping such as reporting hazards and damages.
12. Data & Privacy
MIX Coworking collects and processes limited personal data necessary to provide and manage our Services.
We collect:
Contact details (name, phone (optional) and email address) when you register and book through Skedda.
Your name and email if you sign up for the seasonal newsletter through MailerLite.
Payment information when you make payments through Stripe, our secure payment processor.
Your information is used to:
Manage bookings, memberships, and communication;
Process payments and issue invoices;
Send relevant updates, notices, and newsletters (you may unsubscribe from emails at any time).
We do not sell or share your data with third parties, except as required to provide our Services or comply with legal obligations.

13. Agreement Nature
This agreement allows you to use the Services but does not create a lease or sublease.
You are not a tenant of MIX Coworking, and no property rights are conferred.
14. Force Majeure
Neither party is liable for delays or failures caused by events beyond their control, including acts of God, pandemics, war, terrorism, civil unrest, or natural disasters.
If such an event lasts more than 30 days, either party may terminate this agreement without penalty.
15. Governing Law
These Terms are governed by the laws of the Republic of Ireland. All disputes will be subject to the exclusive jurisdiction of the Irish courts.
